Sale
General
​
These conditions are valid for any sale as well as any deposit.
Disputes to these conditions will be submitted to the courts of Brussels.
​
The depositor
​
The depositor is the person depositing a lot.
The depositor has the right to change his mind and withdraw his deposit before the sale, however he risks storage, expertise and photography costs.
Any specifics in the description or reserve price must be discussed at the time of deposit.

The Seller
​
The seller is the person who deposited an awarded lot.
The sales commission on the seller is 8% of the hammer price. The commission is subtracted from the buyer's payment.
The seller is paid within 5 business days after receiving payment from the buyer.

The buyer
​
The bidder to whom the lot is awarded is the buyer.
The buyer is considered to be acting in his own name.
Disputes will be examined by the auctioneer or bailiff.
The bidder will communicate to Rix Enchères his name, address, telephone number and possibly his identity card or passport, as well as any information, particularly banking information, that may be requested. Private information is kept confidential.

Sale price and resale right
​
The buyer will pay Rix Enchères. the hammer price increased by 20% fees (including VAT).
In the event of “live” auctions, the Auction House will charge the buyer an additional commission: 3% on bid from Interencheres.

Payment - Billing - VAT
​
As soon as the lot is awarded to a buyer, the risks pass to him and he is required to pay the price. Payment is made in cash in Euro.
Rix Enchères accepts cash up to three thousand euros (3,000 Euros).
If the total amount of the sale is greater than three thousand euros (3,000 Euros), the buyer may pay said amount in cash and the balance must be paid electronically (Bancontact, Visa, Master Card and Union Pay) or by transfer banking.
In these last two cases, the goods will only be delivered after receipt of the remaining amount due.
The invoice request must be made no later than the fifth day of the week following the sale.
VAT is included in the sale price but not deductible, cf. Art. 8.

Collection of lots
​
Lots are not collected during the sale. They must be done within ten working days following the sale and after full payment. Any lot not collected within the set deadline will be stored at the buyer's expense.
Rix Enchères provides a packaging and shipping service.
The transport of the lots is the responsibility of the buyer and Rix Enchères is not responsible for any damage that may occur during the transport of the purchased lots. The buyer is solely responsible for import regulations and related costs when shipping outside the EU.

Non-payment or non-collection of lots
​
In the event of failure to pay for the lot and/or collect it within the set deadline, the buyer will be liable, without prior notice, for late payment interest of 2% per month, from the end of the deadline. kidnapping. In addition, Rix Enchères is authorized to take, at its option and subject to all other rights and actions, after formal notice, the following measure(s):
• store the lot, insure it at the buyer's expense and only deliver it after full payment;
• legally compel the buyer to pay and/or collect the lot, where applicable under penalty of penalty;
• cancel the sale of the lot and possibly other lots acquired during the sale or previous sales;
• put the lot back on public sale, any deficit compared to the first sale being the responsibility of the defaulting buyer, as well as the costs inherent in the resale, the defaulting buyer not being able to claim anything in the event of resale bonus;
• keep any other lot sold during the same sale or during previous sales until the total amount has been paid;
• sell any property which belongs to the buyer and is on deposit at Rix Enchères, the sum thus collected being allocated to the payment of the amounts owed by the buyer;
• refuse any subsequent bid made by the defaulting buyer or on his behalf.

Description of the lots
​
The descriptions are produced in good faith and with expert support. However, the lots are put up for sale with their imperfections, faults and possible errors in description. Rix Enchères is not responsible for any errors in the description or evaluation of the lots, which are given for information only.
The same applies to the author, signature, date, provenance, attribution.
The buyer will form his own opinion on the lot and no complaints of any nature whatsoever will be accepted, even if they relate to the description in the catalog, once the award has been made.
Accidents and restorations observed will be mentioned.

Purchase orders and telephone auctions
​
The buyer who wishes can give purchase orders or participate in the auction by telephone. In the latter case, the buyer must confirm his participation in the sale by e-mail, give his identity and communicate any information that may be requested by Rix Enchères which reserves the right to request bank references.
The bidder undertakes to bid at least the low estimate in the catalog.
Rix Enchères is not responsible for errors made by the customer in indicating the number of the lot he wants to acquire or the telephone number where to call him, nor for various problems with telephone lines (telephones busy, interrupted lines, cell phones, etc.).
If two purchase orders relate to the same lot for the same amount, preference will be given to the order arriving first.

All our sales are subject to the special margin regime, non-deductible VAT.
